Who Are Social Services and Why Might They Get Involved?

Social Services—often referred to as Children’s Services when dealing with child protection matters. They are part of the local authority (council) in your area.

In England and Wales, they have a legal duty under the Children Act 1989. As well as subsequent legislation to protect children and promote their welfare. Their primary aim is to ensure that children are safe, well cared for, and free from harm or neglect.

Social Services may become involved with a family for several reasons, including:

Concerns about neglect or abuse

This may include physical, emotional or sexual abuse, or neglect of a child’s basic needs.

Reports from schools, doctors, neighbours or the police

Professionals who come into contact with children are legally required to report any safeguarding concerns.

Parental difficulties

This may involve issues such as domestic abuse, mental health problems, substance misuse, or severe financial instability. All of which could impact the child’s safety or wellbeing.

Requests for help from parents themselves

Some families seek voluntary support from Social Services when they are struggling to cope.

Family Court and Social Services

Social Services can offer support voluntarily. However, if they believe a child is at risk, they may apply to the Family Court for a Care Order or Supervision Order. This is a formal legal process where the local authority asks the court for permission to intervene in the child’s living arrangements.

Our Social Service Solicitors

Our solicitors are specialists in child protection law and are committed to achieving the best outcome for you and your children. Legal Aid is available for parents and those with parental responsibility in care proceedings, meaning your legal costs will be covered.
